12  Appropriations (Fasano) recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 15, between lines 5 and 6,
16  
17  and insert:  
18         Section 12.  Subsection (3) of section 97.0575, Florida
19  Statutes, is amended to read:
20         97.0575  Third-party voter registrations.--
21         (3)  A third-party voter registration organization that
22  collects voter registration applications serves as a fiduciary
23  to the applicant, ensuring that any voter registration
24  application entrusted to the third-party voter registration
25  organization, irrespective of party affiliation, race,
26  ethnicity, or gender shall be promptly delivered to the
27  division or the supervisor of elections. If a voter
28  registration application collected by any third-party voter
29  registration organization is not promptly delivered to the
30  division or supervisor of elections, the individual collecting
31  the voter registration application, the registered agent, and

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB's 960 & 1010 Barcode 801126 1 those individuals responsible for the day-to-day operation of 2 the third-party voter registration organization, including, if 3 applicable, the entity's board of directors, president, vice 4 president, managing partner, or such other individuals engaged 5 in similar duties or functions, shall be personally and 6 jointly and severally liable for the following fines: 7 (a) A fine in the amount of $50 $250 for each 8 application received by the division or the supervisor of 9 elections more than 10 days after the applicant delivered the 10 completed voter registration application to the third-party 11 voter registration organization or any person, entity, or 12 agent acting on its behalf. A fine in the amount of $250 for 13 each application received if the third-party registration 14 organization or person, entity, or agent acting on its behalf 15 acted willfully. 16 (b) A fine in the amount of $100 $500 for each 17 application collected by a third-party voter registration 18 organization or any person, entity, or agent acting on its 19 behalf, prior to book closing for any given election for 20 federal or state office and received by the division or the 21 supervisor of elections after the book closing deadline for 22 such election. A fine in the amount of $500 for each 23 application received if the third-party registration 24 organization or person, entity, or agent acting on its behalf 25 acted willfully. 26 (c) A fine in the amount of $500 $5,000 for each 27 application collected by a third-party voter registration 28 organization or any person, entity, or agent acting on its 29 behalf, which is not submitted to the division or supervisor 30 of elections.
